Refunds, Returns & Consumer Gurantees Policy
At Mayfair Autohaus, we want our customers to purchase with confidence. Our vehicles are sold in accordance with applicable Victorian motor vehicle legislation and the Australian Consumer Law (ACL).
Nothing in this policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded.
Change of Mind
Except where a statutory cooling-off right or other legal right applies, Mayfair Autohaus is not required to provide a refund or accept the return of a vehicle simply because you:
-
change your mind;
-
decide you no longer want or need the vehicle;
-
find a similar vehicle elsewhere at a lower price; or
-
change your personal or financial circumstances.
Any rights you may have to cancel a vehicle purchase during a statutory cooling-off period are outlined below.
Cooling-Off Period
Where applicable under Victorian law, purchasers buying a vehicle from a licensed motor car trader are entitled to a cooling-off period of three clear business days after signing the contract of sale.
If a purchaser terminates a used vehicle contract during the applicable cooling-off period, Mayfair Autohaus may retain $100 or 1% of the purchase price, whichever is greater, as permitted by law.
The cooling-off period does not apply in certain circumstances, including where the purchaser accepts delivery of the vehicle during the cooling-off period or where another statutory exception applies.
Full details of the applicable cooling-off rights and conditions will be provided in the contract of sale.
Deposits
Deposits are dealt with in accordance with the terms of the relevant contract of sale and applicable Victorian law.
Where a customer has a legal or contractual right to cancel a purchase, any refund or retention of a deposit will be handled in accordance with those rights.
Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law applies to a vehicle purchased from Mayfair Autohaus, any applicable consumer guarantees and remedies will apply in accordance with the law.
Statutory Warranty on Used Vehicles
Where applicable, Mayfair Autohaus provides the statutory warranty required under Victorian law.
Generally, a statutory warranty applies to a used vehicle that is less than 10 years old and has travelled less than 160,000 kilometres at the time of sale.
The statutory warranty applies for three months or 5,000 kilometres after purchase, whichever occurs first, subject to the exclusions and conditions prescribed by law.
Some vehicles and certain faults, defects, damage, accessories and other items may not be covered by the statutory warranty.
Where a statutory warranty applies, the relevant information will be provided as part of the vehicle sale documentation.
Existing or Disclosed Defects
As Mayfair Autohaus sells pre-owned vehicles, vehicles may show reasonable signs of age, previous use and wear.
Where a particular defect is disclosed in accordance with applicable Victorian motor vehicle laws before purchase, that defect may be excluded from the applicable statutory warranty.
This does not exclude any rights a purchaser may otherwise have under the Australian Consumer Law that cannot lawfully be excluded.
Finance
Mayfair Autohaus does not provide or arrange finance.
Where requested, we may introduce customers to independent finance brokers. Any finance application or agreement is between the customer and the relevant broker and/or finance provider.
Where a vehicle purchase is expressly made subject to finance or another condition in the contract of sale, cancellation and any refund of a deposit will be determined in accordance with the terms of the contract and applicable law.
